ACCEPTANCE AND SCOPE OF THE AGREEMENT

This Notice, the Policies, and these terms and conditions create an agreement between you and Doctor ÁNGELA RAMÍREZ.

The Policies, the Legal Notice, the Terms, General and Particular Conditions, Warranties and Additional Clauses apply to all contracts for (“Products” or “Prosthetics” or “Treatments” or “Procedures”) or Services contracted by a client (“Client” or “Patient” or “User”) with Doctor Ángela Ramírez. All Agreements and/or Contracts with Doctor Ángela Ramírez are obligations of means and not of results, and are governed by Colombian law.

Doctor Ángela Ramírez defines the acceptance of a contract as the moment at which the patient (“Client” or “Patient” or “User”) makes use of the “Services”, the websites owned by Doctor Ángela Ramírez, and/or has received the totality of instructions, notification of risks and possible outcomes for the processing of a “Treatment” (“Products” or “Prosthetics” or “Treatments” or “Procedures”) or Medical or Dental Service, and the patient (“Client” or “Patient” or “User”) consents to it being carried out by Doctor Ángela Ramírez.

The aforementioned terms and conditions of use regulate the activity of the “Users” or “Clients” or “Patients” of Doctor Ángela Ramírez and are legally binding on all users and staff of Doctor Ángela Ramírez’s practice.

The quality policy for the dental services and treatments performed grants patients a quality warranty, which is governed entirely by the following provisions:

The regulations applicable to the dental procedures performed are governed by Colombian law, domiciled in the city of Bogotá, Colombia.

The warranty is granted in accordance with Law 1480 of 2011 and other rules that complement or amend it, and is applicable exclusively within Colombian territory.

All warranty claims, without exception, will be handled at the practice of Dr. ÁNGELA RAMÍREZ, located in the city of Bogotá, Colombia.

National and foreign patients, whether by nationality or residence, may access the warranties for dental services solely and exclusively at the practice of Dr. ÁNGELA RAMÍREZ, in the city of Bogotá, Colombia. Consequently, the resolution of claims does not and will not include costs related to air and/or ground travel, nor other costs and/or expenses for lodging, meals, or any other expense incurred by patients in order to receive the required dental treatments.

The resolution of complaints related to patient dissatisfaction due to deficiencies in the quality and adequacy of the dental treatment will be handled in accordance with the scientific protocols implemented at the practice.

SCOPE AND CONDITIONS OF THE WARRANTY

Treatments carry a 1-year warranty for damages related to the procedures performed. (See attached warranty policy)

The warranty does not cover misuse or failure to follow recommendations and instructions.

The patient must attend check-up and/or maintenance appointments according to the treatment performed, which will be recorded in the physical clinical history.

Periapical or panoramic X-rays may be requested at the Dentist’s discretion in order to monitor the structures and, with the help of this diagnostic aid, obtain a better treatment prognosis. This cost must be borne by the patient.

This X-ray or another type of diagnostic aid may also be requested if, during a check-up appointment, an anomaly is observed in the treatment performed; this cost must be paid by the patient.

DEFINITION AND LIMITS OF THE WARRANTY

Doctor Ángela Ramírez starts from the premise that “Warranty(ies)” in relation to a dental “Treatment” can be understood as: (1) providing a warranty on the result(s) of a “Treatment”, (2) providing a means of compensation to “the Patient” when a given result or expectation is not achieved.

Based on these concepts, we inform you that the Codes of Ethics in Dentistry and/or Dental Associations warn that “promising and guaranteeing results constitutes a negligent and harmful attitude toward the Patient, and, therefore, this action is subject to sanction.” Doctor Ángela Ramírez CANNOT guarantee that the contracted “Services” and “Treatments” will permanently resolve your oral health problem in each and every case.

For any claim, the patient shall act with a reasonable degree of professionalism and diligence with respect to the warranty claim granted under contract and for any services rendered or provided by Doctor Ángela Ramírez (warranty agreed at the time of contracting the service). Subject to local law, “the patient” may have a warranty of conformity for (“Products” or “Prosthetics” or “Treatments” or “Procedures”) or Services granted under contract, acquired for a maximum duration of one year. Doctor Ángela Ramírez makes no other promise nor grants any other warranty regarding the “Services”, in particular given that Doctor ÁNGELA RAMÍREZ cannot guarantee that:

  1. The use, maintenance, and hygiene will be appropriate, correct, timely, and properly carried out; and will be free from interruptions or errors.
  2. The services will be free from tampering, corruption and/or accidents, improper use, interference, or other intrusions affecting their stability and integrity; therefore, the patient waives any claim in relation to such circumstances.

LIMITED LIABILITY

Doctor ÁNGELA RAMÍREZ will provide her “Services” with a reasonable degree of professionalism and diligence. Subject to local law, you have a warranty of conformity for the services acquired for a maximum duration of one year. The Doctor makes no other promise or warranty in relation to the services and, in particular, does not guarantee anything beyond the agreed warranty. (Please read the warranties carefully)

The patient AGREES THAT, UNLESS REQUIRED BY APPLICABLE LAW, DOCTOR ÁNGELA RAMÍREZ HAS NO OBLIGATION WHATSOEVER TO CONTINUE MAKING HER “SERVICES” AVAILABLE; AND WILL NOT BE LIABLE TO “THE PATIENT” IF THE SERVICES ACQUIRED CEASE TO BE AVAILABLE AND/OR FUNCTIONAL.

EXCLUSION OF WARRANTIES:

In the event that you are exercising any applicable right to warranty, refund, or compensation, under no circumstances shall Doctor ÁNGELA RAMÍREZ, her officers, employees, agents, contractors, or licensors be liable for any loss or damage in which:

  1. There is no breach of a legal duty of care owed by Doctor ÁNGELA RAMÍREZ or any of our employees or agents;
  2. It is not a reasonably foreseeable result of such a breach;
  3. Any increase in the loss or damage results from your own breach of any term of this agreement;
  4. It results from a decision by Doctor ÁNGELA RAMÍREZ to remove or deny access due to improper conduct by “the Patient”, to refuse to process any “Service”, information, or content, to warn you, to suspend or cancel your access to the “Service”, or to take any other action while investigating an alleged violation, or as a result of Doctor ÁNGELA RAMÍREZ’s conclusion that a violation of this agreement has occurred.
  5. The agreed warranty period has elapsed.
  6. Doctor ÁNGELA RAMÍREZ makes NO promise or warranty in relation to repair and/or repetition services for “Treatments” not performed by Doctor ÁNGELA RAMÍREZ, and, in particular, does not guarantee prior “Treatments” that “the Patient” already has that were not performed by the Doctor, and/or “Treatments” and/or “Re-Treatments” handled by entities other than Doctor ÁNGELA RAMÍREZ.

Doctor ÁNGELA RAMÍREZ starts from the premise that “Warranty(ies)” in relation to a dental “Treatment” can be understood as:

  1. Providing a warranty on the result(s) of a “Treatment”; therefore, the Doctor makes NO promise or warranty in relation to the services and, in particular, does not guarantee anything beyond the agreed warranty. Doctor ÁNGELA RAMÍREZ makes NO promise or warranty in relation to the services and, in particular, does not guarantee prior “Treatments” not performed by Doctor ÁNGELA RAMÍREZ and/or “Treatments” handled by other, different entities.
  2. Providing a means of compensation to “the Patient” when a given result or expectation is not achieved; therefore, under the WARRANTY CERTIFICATION, Doctor ÁNGELA RAMÍREZ is ONLY obligated to repeat the “Treatment” where applicable, or to repair or, if necessary, replace the damaged dental prosthesis(es) that were manufactured by Doctor ÁNGELA RAMÍREZ and acquired by the warranty holder — NOT to refund any payments made in any of their forms.

PRIVACY POLICY

In compliance with Statutory Law 1581 of 2012 on Data Protection (LEPD) and the regulations implementing it, this Privacy Notice is intended to obtain the express and informed authorization of the Data Subject for the processing and transfer of their data to third-party entities. The conditions of processing are as follows:

Ángela Ramírez will be responsible for the processing of your personal data. In order to provide comprehensive service as a client, the personal data collected will be processed for the following purposes: commercial purposes, behavioral information, commercial credit, and accounting, tax, and administrative management.

Doctor ÁNGELA RAMÍREZ’s policy is to warn you of improper conduct and advise you of corrective actions. However, flagrant violations of these terms, determined solely by Doctor ÁNGELA RAMÍREZ, may result in the immediate termination of the service.
